1. Acceptance of Terms
By using DodgePrint, you agree to these Terms of Service. If you don't agree, please don't use our services.
These Terms of Service ("Terms") constitute a legally binding agreement between you and DodgePrint, Inc. ("DodgePrint," "we," "us," or "our") concerning your access to and use of the DodgePrint platform and services.
By registering for an account, accessing, or using any part of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any other policies referenced herein.
2. Our Services
2.1 Service Description
DodgePrint provides a comprehensive print-on-demand automation platform that includes:
- Multi-platform inventory synchronization
- Automated product listing management
- Order processing and fulfillment automation
- Real-time analytics and reporting
- Dynamic pricing optimization
- API integrations with major e-commerce platforms
- Bulk editing and management tools
- Customer support automation
2.2 Service Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue any part of our services with reasonable notice.
2.3 Beta Features
We may offer beta features marked as "Beta," "Preview," or "Early Access." These features are provided as-is without warranties and may be modified or removed at any time.
3. Your Account
3.1 Account Registration
To use DodgePrint, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Have the legal authority to enter into these Terms
- Not have been previously banned from using our services
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use
- Ensuring your connected platform API keys are kept secure
Warning: Never share your account credentials or API keys. DodgePrint staff will never ask for your password.
4. Acceptable Use Policy
4.1 Permitted Use
You may use DodgePrint only for lawful purposes and in accordance with these Terms. You agree to use our services solely for managing legitimate print-on-demand businesses.
4.2 Prohibited Activities
You agree NOT to:
- Use our services for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Transmit any malicious code, viruses, or harmful data
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt our services or servers
- Sell, rent, or lease your account access to others
- Use our services to infringe on intellectual property rights
- Engage in any activity that harms DodgePrint or its users
5. Billing & Payment
5.1 Subscription Plans
DodgePrint offers various subscription plans with different features, limits, and pricing. Current plans and pricing are available on our pricing page and may be updated from time to time.
5.2 Payment Terms
Billing Cycle & Payment
- Subscriptions are billed in advance on a monthly or annual basis
- Your subscription automatically renews unless canceled
- All fees are non-refundable except as required by law
- Prices are subject to change with 30 days' notice
5.3 Free Trial
We may offer a free trial period for new users. Trial terms include:
- Payment information may be required to start your trial
- You won't be charged during the trial period
- Your subscription begins automatically when the trial ends unless canceled
- Trial features may be limited compared to paid plans
6. Intellectual Property
6.1 DodgePrint Property
All DodgePrint content, features, functionality, and technology are owned by DodgePrint and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of our services.
6.2 Your Content
You retain ownership of content you upload to DodgePrint. By using our services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve our services.
6.3 Feedback
Any feedback, suggestions, or ideas you provide about DodgePrint become our property and may be used without compensation or attribution to you.
7. Termination
7.1 Termination by You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
7.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms or our policies
- Your payment fails or is disputed
- We suspect fraudulent or illegal activity
- Required by law or court order
7.3 Effect of Termination
Upon termination:
- Your right to use our services ceases immediately
- You remain liable for any outstanding fees
- We may delete your data after a reasonable retention period
- Provisions meant to survive termination will remain in effect
8. Limitation of Liability
Disclaimer of Warranties
DODGEPRINT SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DODGEPRINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF OUR SERVICES.
8.2 Total Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless DodgePrint, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through our services
10. Dispute Resolution
10.1 Informal Resolution
Before filing a claim, you agree to try to resolve any dispute informally by contacting us at [email protected]. We'll try to resolve the dispute informally for 30 days.
10.2 Binding Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration will be conducted in San Francisco, California.
10.3 Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
11. General Provisions
11.1 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
11.2 Changes to Terms
We may modify these Terms at any time. We'll notify you of material changes via email or through our services. Continued use after changes constitutes acceptance.
11.3 Entire Agreement
These Terms, along with our Privacy Policy and other referenced policies, constitute the entire agreement between you and DodgePrint.
11.4 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
